FALSE PRETENCES
[VALUELESS CHEQUE CASHED THREE CHARGES ADMITTED A salesman, Charles Richard Legge, aged 33 (Mr. Alan Moody), pleaded guilty when charged in the Police Court yesterday on three counts of fraudulently obtaining money by means of a valuelessi cheque for £23. Detective-Sergeant McHugh said that on April 13 accused presented a cheque purporting to be worth £23 at the office of a city firm and received an advance of £5 10s. On April 18 he received a further advance of £5 10s on the cheque and the following day he collected the balance of the £23. The cheque was later paid into the bank apd was returned marked "no account.". The cheque form had been obtained by accused from a man he met in a hotel. Accused had previously been convicted for false pretences. In asking for leniency Mr. Moody said that prior to the commission of the offence accused had been without employment &nd had been drinking excessively. He was now very repentant and restitution would be made if he were given a chance. The magistrate, Mr. W. R. McKean, fined accused £5 on one of the charges and ordered the payment of £23 restitution within a month. On another charge accused was ordered to come up for sentence on June 29 and on the third count ho was convicted and discharged. "You are very fortunate indeed in escaping a term of imprisonment," said the magistrate to accused.
