MORTGAGORS' RELIEF
NEW AUCKLAND COMMISSION CITY PROPERTY DISPUTES The appointment of adjustment commissions for the Auckland and Wellington urban areas, under the Mortgagors and Tenants' Relief Act, follows representations made to the Government by various city interests.
In Auckland it was felt tlmt, although the services of the commission having jurisdiction in the city were appreciated, there was a definite need, when city interests were being dealt with, to have as commissioners men with special and wide experience of city values, as compared with commissioners whose interests were more in rural areas.
The duties of the metropolitan commissions will be to investigate anc! report upon applications by mortgagors and lessees for relief, referred to them by the Court, and generally to encourage voluntary settlements between mortgagors and mortgagees and lessees and lessor:?. The procedure for applying for relief was outlined in a notice gazetted subsequent to the passing of the Act. This stated that applications must be made to the appropriate Court setting out the nature of the relief sought. In cases where the parties cannot agree, the registrar of the Supreme Court or clerk of the Magistrate's Court, as the case may be, shall refer the applicants to an adjustment commission. After receiving the commission's report the registrar shall, after reference to the respective parties, fix a time and place for the hearing of the application by the Court. There are already two commissions for the Auckland province, which is divided for the purposes of the Act into the North Auckland and South Auckland districts. Until the appointment of the commission announced yesterday, Auckland City was included in the North Auckland area, which extends from Mercer to the extreme north.
