Goodwin, of Wellington, company director, ag.iinst the Auckland Automobile Racing Club, Limited, Mr. 11. J. Butcher, and Fox Movietone, Limited. In their statement of claim, the plaintiffs allege that they travelled from Wellington to t ie Ninety-Mile Beach, North Auckland, by aeroplane, to take cinematograph pictures of the speed tests and preliminaries being conducted by-the Auckland Automobile Racing Club, Limited. They allege that on January 26. while endeavouring to lake the pictures, Mr. Butcher, the managing director, together with other employees of the Racing Club and employees of Fox Movietone, Limited, assaulted them and prevented them from taking the pictures and from manufacturing as many feet of film and making as much profit by the sale of the film to companies throughout the world, as they would otherwise have done.

Both Mi. Butcher and the Auckland Automobile Racing Club, Limited, have already filed a statement of defence, denying the allegations of the plaintiffs.
