ACCIDENT IN ORCHARD.
STEPLADDER BLOWN OVER. HEAVY FALL WHILE PRUNING. COMPENSATION CLAIM FAILS. As the result of an injury alleged to have been received through falling from a stnpladdcr while pruning a fruit tree in a Henderson orchard, Nicholas Ozich, a Dalmatian labourer, sought compensation from his former employer, Joseph Barlicli, in the Arbitration Court yesterday. Mr. Justice Fra/er presided, his associates being Mr. W. Cecil Prime, employers' assessor, and Mr. A. L. Monleilh, employees' assessor. Plaintiff stated that on November 24 the, stepladder upon which he was standing was blown over in a. high wind and he fell heavily. As a result, the already weak condition of his heart was greatly aggravated and ho had since been unable to work as well as before. As compensation for his incapacity he sought a weekly payment of £2 6s Od as from November 24. Defendant denied liability and called, medical evidence to show that plaintiff's condition was not due to the fall.
Defendant was awarded judgment and £5 5s costs.
