WOUNDING OF BROTHER

Arrested sit a late hour hist night, Norman Alan Miller, a hawker, aged 21, appeared in the Magistrate's Court today, charged with the attempted murder i.f his brother, David Miller. It was alleged by tho police that during a scuffle thai took pjace between the two brothers in their home in Arlington Street, Mount Cook, late last evening, the accused drew a revolver from his pocket and shot his brother in the side. Accused was arrested later, and the injured man was admitted to the hospital. Accused was remanded for a week. Making application for bail, counsel for the accused said a charge of attempted murder was serious, but on the facts of the case he I bought the charge might possibly be reduced to one of causing actual bodily harm, in which case accused was entitled to bail. Accused for many years had been residing with his brother and family. Last night ho arrived home in a very drunken .state, and when his brother saw him and proceeded to deliver salutary punishment the accused drew a revolver from his pocket, and in the ensuing scuffle for possession of the weapon it exploded and Ihe brother was injured. The injury was not severe, and the incident could not be regarded as a wilful attempt to murder. Accused was employed, beiii£ a dealer in fish and sacks, and was doing quite well. Tie recognised that the charge was serious from some points of view, and would be willing lo take out a prohibition order against himself. Detective-Sergeant Revel 1 said that the injured man was admitted to the hospital at an early hour in the morning, and he would suggest that the question of bail be stood over. The magistrate adopted this course.
