PETITION BY WIFE.
HUSBAND'S RETURN ORDERED [FROM OIJK OWN CORRESPONDENT. ] HAMILTON, Tuesday. A petition for restitution of conjugal rights was granted to Mona Florence Smurthwaito (Mr. J. F. Strang) by Mr. Justice Herdman in-the Hamilton Supreme Court to-day. Petitioner said that on October 28, 1930, she married Ronald •Smurtbwaite in Rotorua. She was then a waitress, and it was agreed that she should continue in her employment until respondent mado a home for her in Hamilton, where he had obtained work as a baker. Respondent visited her occasionally, and in April, 1931, he agreed to bring her to Hamilton. He did not come for her. She went to "Hamilton, and respondent told her lie did not want to havo anything more to do with her. He said he was unable to save money or make a home for her. Petitioner said she asked him if there was another girl in the case, and he admitted thero was. In reply to His Honor petitioner said she wanted her husband back. A law clerk stated that respondent had told him that he had no intention of taking his wife back. Respondent was ordered to return to petitioner within 14 days.
