Extraordinary methods adopted in an effort to make sales were alleged- against a radio dealer in the IXew Plymouth Magistrate's Court today, when E. T. Marsh was charged that, not being the holder of a radio licence, he was in possession of a receiving set. He pleaded guilty. Senior-Sergeant McCrorie said defendant had had the set for about 12 months without having a licence for it. The department asked for a fairly heavy penalty. Counsel said defendant had had the set thrust upon him. A dealer had approached him with a view to selling the set, but he had explained that he had no intention of buying (die. In the usual way the dealer suggested that defendant should allow him to instnl the set on trial, saving Shove would be no harm done if he did not purchase itDefendant agreed tint it would do no harm, but' again assured the dealer that he had no intention of purchasing it. The set was installed and had been there for 12 months. It. had to lie admitted that it had been used on a few occasions. When the summons was is-ued defendant went to tho dealer and asked him to remove the apparatus, as it had trot hirn into trouble. A week later it had not been removed. The Magistrate.', Mr. I!. W. Tate: It lias never been paid f"r ? Counsel: Nothing has been paid and defendant has no intention of [laying for it. The Magistrate: What does tho wireless set cost? Counsel: Probably about £SO. The Mngistiate.: it seems pretty easy to get a wireless sot. Counsel: 't is even easier than getting a motor car Counsel referred to the Act and expressed doubt whether, in such circumstances. defendant could be said to be in possession of tho set. All tie had done was to give storage to the set. which belonged to the dealer Apparently it was thought that by a wearing-down process a sale wou'd be brought about The magistrate said the circumstances should be placed before tho department to see if it could do anything with ihe dealer A conviction was entered and defendant was ordered to pay 10s costs.
