PROBATION FOR TWO YEARS.
RESTITUTION UP TO £SO
Slated to bo in bad health, Dominic Daniel Petty, aged 40, Slovenian (Mr. Conlan), was placed on probation for two years when ho appeared in tlio Polico Court yesterday for sentenco on charges of theft. 110 was with stealing a quantity of wheat, maize, oats and chaff, valued at £214 7s 6d, (lie property of the National Mortgage and Agency Company of New Zealand, Limited. Mr. Cotilan said accused had been employed as a storeman by A. M. Palerson t'or throe years, and prior to that time had been employed by another firm for 16 years. Prior to the date of tho offences, accused's record had been an excellent one. Becoming ill, he had employed another man to do bis work, and ho ' was unable to pay him. He had conceived tho idea of selling goods under his care.
Counsel added that, accused had given tho police every assistance. If placed on probation, he was prepared to pay £2O restitution immediately. The magistrate, Mr. F. K. Hunt, said ho had discussed the case with the probation officer. Accused had been in a position of trust and under ordinary circumstances the abuse of such trust would merit imprisot.n out However, accused was suffering from an illness and imprisonment would probably mean his death. In admitting accused to probation for two years, tho magistrate ordered that ho should make restitution up to £SO, £2O of which should be paid immediately.
