THEFT OF A CAKE.
RAILWAY PORTER FINED. "Accused held a position of trust and he abused it," said the magistrate, Mr. F. K. Hunt, S.M., in the Police Court yesterday, in imposing a fine of £5 on Edward Charles Burgess, who pleaded guilty to stealing a cake valued at £l, the property of Elinor Smith. Mr. Matthews appeared foi' tho accused. Chief : Detective Hammond said that the cake had been sent by rail from Okaihau to Mrs. Smith, of Newmarket. Accused, who' was a porter at the Newmarket railAvay statiprt; received the box and removed the Cake, delivering the empty box on the following day. . ,The calco was subsequently found in Jpis possession. Accused was married find his wife was in delicate health. Mr. Matthews snid that..accused had been eight years in the service, but he had recently been drinking and had since boon dismissed. Neither he nor his: wife ate cake, and his'action was apparently just a piece of drunken mischief.,'. Twenty-four hours were allowed in which to pay' the' fine, in dofault one month's 'imprisonment. .•> . ,
