MILKMAN'S INJURY.
COMPENSATION AWARDED.
YEAR'S FULL INCAPACITY
Judgment has been given by the Arbitration Court for plaintiff in the claim by Reginald Spencer Hutton, milk roundsman, of Arch hi 11 (Mr. Tuck), against Stonex Brothers, milk vendors (Mr. West). Reviewing the case the judgment stated that the plaintiff had been in Ihe defendant's employ for 17 years at the time of an accident on January 5, 1929. Ho handled big milk cans weighing 1501b. earh, and used a serving can weighing about 371b. On January 5 Hutton had just lifted a big can off the ground when he felt a. sudden pain across his left chest and dropped the can. He could not move for some time,- but after sitting for a while felt easier. He had not since lifted a full can on to the cart and is not able to carry a full serving can. Plaintiff had had three attacks of rheumatic fever, the last one over 25 years ago', and a number of doctors gave evidence as t,o the diseased condition of his heart. It was agreed that ho was now fully incapacitated. The Court thus summed up its decision: "As plaintiff sustained an accident arising out of an in the course of his employment he is entitled to compensation for it, but such compensation must be limited to the injury he sustained as the result of such- accident. One year's incapacity will amply cover the incapacity due to tho strain on January 5, and plaintiff is awarded full compensation for one year from the time he ceased work, namely, January 13, 1929., If the parties cannot agree on the amount the Court will fix it." Plaintiff was allowed £lO 10s costs, with disbursements and expenses.
