A CARRIER'S ACCOUNTS.

QUESTION OF LIABILITY* MONEY NOT PAID OVER. [BY TELEGRAPH. —OWN CORRESPONDENT. 3 WAIUKU, Thursday, The liability of the W&ikato and Thames Valley Calf By-Products, Ltd., for carriers' accounts incurred in collecting and carting calves sent to tho company last season was tho question at-issue in ail action brought before Mr. F. H. Levien, S.M., in the Waiuku Magistrate's Court to-day by Peter Parry, carrier, Waiuku (Mr. J. S. Burt), against tho company (Mr. A. Swarbrick) for the rocovery of £94 13s Id, comprising £63 163 9d spent in tho purchaso of calves, £3O 4s 4d for cartago of calves, and l<r.s for sacks and salt. The company's defence was that too liability for payment of the claim rested with one 6. W. Barker, who was deputed bv the company to conduct its caLIniying end calf-collecting business in tho Lower Waikato last season. . Evidenco was given by tho plaintiff (hat tho managing-director of tho company, Mr. Samuel Lye, in company with Barker, approached him about the middle of 1928 to collect and cart calves to tlio railway station in tho Waikato district. He signed an agreement with Barker to carry out the work. Ho was to bo supplied with the money to purchaso tho calves, but on occasion it was not to hand and hr> used his own money to tho extent of £63 16s fld. Evidenco given by Samuel Lyo and *. W. Luxford. secretary of the company, was that Barker was given money to buy (lie calves. lie had been paid sufficient to pay tho carriers, and he had also had over '.CIOO for which ho had not accounted. lie could not, now be found. Tho magistrate reserved his decision.
