NEWMARKET TRAM STOPS.
THE " FLOATING " SECTION.
LEGAL POSITION DISCUSSED
The present "floating" tramway section in Newmarket was discussed at the meeting of tho Newmarket Borough Council last evening, when a report on the legal position was presented by the borough solicitors.
The report stated tho Auckland Transport Board had approved the action of the City Council in making tho present arrangements. Although a written agreement establishing such a floating section might be desirable, it was possible this would not prove acceptable to tho Transport Board. If matters stood as at present no difficulty should arise if the board at any future time discontinued the arrangement, as whenever the board decided to make an alteration the council could then take action, either under the deed of delegation or otherwise. Reviewing the history of the deed of delegation the clerk said that with the assumption of control of the trams by the board, which was composed of representatives of the local bodies, the deed of delegation lapsed. Members of tho council expressed the view that their representative on tiie board could be approached if necessary to protect their interests, and no action was taken in the matter.
