PROFESSOR WILLIAM HEWITSON, B.A, Dear Sir,— Whereas at a meeting held on sth November, 1928, of a Special Committee, consisting of Revs. E. R. Harries, T. H. Roseveare, and D. D. Scott, tho which committee was set up by the Auckland Presbytery to deal with tho removal of a suspension which had been in operation against mo for twelvo (12) years. It was discovered on investigating the records of the Auckland Presbytery on tho matter, that:— (a) That two resolutions that had been passed by Presbytery and. that wer<« favourable to my case had not been recorded in tho confirmed minutes of Presbytery. (b) That whereas 1 had appealed against suspension on tho three grounds, viz.: (1) Irregularity, (2) refusal to hear relevant evidence, and (3) injustice, tho Presbytery records show that only on the first ground did it find against mo, vis., on the ground of "irregularity," but it could not so find on ground No. 2 beeauso of tho fact that tho Moderator of Session had refused to record my evidence, nor under ground No. 3 because the said session had unjustly suspended mo beforo I had an opportunity to lodge ail appeal. / (c) That when Presbytery drew up "reasons" against my appeal for presentation in Assembly, tho men they appointed to do bo wcro a "party" in the case, being members of tho session that had illegally suspended. (d) That these men appointed to draw up reasons, made representation that ' Presbytery had found against inn under different grounds, which representation Presbytery records show to bo contrary (o fact. (c). That Rev. A. A. Murray had re corded his dissent from the confirma tiou of minutes that omitted important resolutions that Presbytery had passed. \ Tho Rev. A. A. Murray and his represenfativo elder wero tho only two members of the Auckland Presbytery who attended au "in hunc effectum" meeting, appointed to deal with my. first suspension. This meeting was illegally "lapsed" at the instigation of my opponents, who sought' thereby to provent my succeeding in oppeal on my first suspension. Undef God's guidanco I was enabled to thwart their purpose, and did succeed in gaining my appeal. Tho omission .of resolutions mentioned under "a" and "e" nbove, succeeded in "covering" tho fact that further prosecution. thereafter entered upon against me. was at the instigation of tho Auckland Presbytery In the foregoing matters I hereby make request in accordance with Standing Orders 21 and 24 "to bo heard by Assembly." and that records qf the Auckland Presbytery and the Papakura Kirk session be called for. As tho "finding" of the Auckland Presby tery on its Special Committee's Report was withheld from mo till yesterday, leaving no time for ordinary procedure, ard as that finding seeks to throw _ responsibility for illegalities and their adjustment upon the Papakura Session, and ns the matter is one of "exceptional circumstances." and as immediate action is "right and needful for doing justice in the particular esse." as provided for in Rule 326 of fhe Book of Order, I respectfully request thf.t fhe mat ter be dealt with under this rule, and such steps taken by Assembly as under God's guidance it mav find necessary in tho interests of tho Church I am, sir, Yours most respectfully.
