GIVING WAY ON THE RIGHT.
AN OBLIGATION TO STOP
COMMENT BY MAGISTRATE
A charge of failing to give way to a vehicle on the right was preferred against John Colo in the Police Court yesterday. Mr. Beckerleg, for defendant, said Colo was driving a. large cur which would have to travel eight feet into a street before the driver could obtain a direct lino of vision. Defendant drove slowly out of Epsoin Avenue and was about Bft. on Manukau Road when another car, driven at an excessive speed was noticed. Defendant stopped, but the other car collided with him.
Sub-Inspector McCarthy said the defendant's car had not stopped, but was travelling at a high speed. This was borne out by a witness. " I am not here to decide a civil claim," said tho magistrate, Air. I*. lv. Hunt. " The car on Manukau Koad may or may not have been travelling at a high speed. All that concerns me is whether defendant gave way to the vehicle on his right. I find that ho did not do so. Even if ho has to drive Bft. over an intersection in order to see along the road, that is no excuse. With a car like that he should fit a periscopo or else stay at home. If necessary, tho obligation is on him to stop jiis car, got out and walk in order to see whether the road is clear. If ever there was a rule of the road for tho safety of motorists it is 'hat they should give way to vehicles on the right." The magistrate was about to impose a fine of with costs, when Mr. Beckerleg asked him to withhold the penalty so thai counsel might, consult with his client as to the advisability of entering an appeal. fi. McCullough and S. E. Poolo were each fined £l, with costs, for failure to givo way to vehicles on tho right.
