SALES OF MOTOR SPIRITS.
DISPUTE AT HAMILTON. OIL COMPANY'S CLAIM FAILS. [BY TELEGRAPH. OWN CORRESPONDENT. J HAMILTON. Tuesday. The reserved judgment of Mr. Justice Blair in the case in which the Texas Company (Australia), Limited, sued the Waikato Associated Farmers, Limned (in liquidation), for £lll7, moneys allegedly due by the defendant company in its capacity of agent for the plaintiff company, in the sale of motor spirits and lubricants, was read m the Hamilton Supreme Court to-day. The defence was that much of the spirit and oil was purchased outright by defendants, and not as agents.
His Honor said he could not make the direction asked for by plaintiff company that certain moneys held by the liquidator were held in trust for the plaintiff company, and he gave judgment for defendants, with costs as on a claim for £lll7 10s 4d, disbursements ant. witnesses' expenses to be fixed by the registrar. An extra day at £ls 15s with extra counsel for two days at £7 7s a day was allowed.
Messrs. Tompkins ant? Wake acted for the plaintiff company, and Messrs. Powell and Williams for the defendant company.
