BOROUGH: RATES PAID TWICE
REMOVAL OF ANOMALY URGED. [BY TELEGRAPH. —PRESS ASSOCIATION. ) HASTINGS, Friday. A peculiar legal absurdity was disclosed at a meeting of the Borough Council. A ratepayer and his solicitor, unknown to each other, paid the demand, and the ratepayer now demanded a refund. The Mayor, quoting legal opinion, said the council had no power to refund money. Crediting the sum to next year's account would amount to a refund, and would be illegal. The money could not be taken from the borough suspense account under present legislation, and if a refund were made by the council they would be per sonally responsible. The council was not the owner of the money, and could not use it, as it belonged to someone else, but that person could not get it back. It was resolved to urge that the Act be amended.
