PERFORMING DOG KILLED.
RUN OVER BY MOTOR-BUS. OWNER'S CLAIM FOR DAMAGES. A claim for £9O damages for the death of a performing dog was preferred by Philip Aylward (Mr. Lennard), against the Passenger Transport Company (Mr. Goutding), in (he Magistrate's Court yesterday. Evidence was given that the dog was the loader of a troupe of four performing dogs which had appeared at theatres in many parts of the Dominion. It was very valuable and plaintiff had refused an offer of £125 for it. On the night of February 2 plaintiff, who was known on the stage as "Captain Cuttle," was walk ing with the dog on the Panmure-Ellerslie Road, when an unlighted bus, belonging to the defendant company, which was travelling very rapidly, appeared suddenly and grazed plaintiff and ran over and killed the dog. For the defence it was contended the bus which killed the dog was not one owned bv the defendant company. The magistrate. Mr. Cutten, reserved his decision.
