ESTREATMENT OF BAIL.
AN APPLICATION REFUSED. PLEA OF ILLNESS SUCCEEDS. An application for estreatment of bail made by the police against Arthur Clark, William Duncan and Frank Sydney Bertrand (Mr. Sullivan) was refused by Mr. J. W. Poynton, S.M., in the Police Court yesterday. Senior-Detective Hammond said Clark was before the Court on Juno 21 on a charge of false pretences. He was remanded until June 28, and again until July 5. Duncan and Bertrand had put up £SO sureties. Clark did not appear in Court on July 5, and was arrested in the Domain two days later. He gave the excuse that he had been ill. He had since been placed on probation. Mr. Sullivan said Clark had a temperature of 104 degrees on July 5, and he submitted the man was not reponsible for his actions. Mr. Hammond: It is silly to say his temperature was 104 degrees. Mr. Sullivan: We can prove it. William Duncan said he knew Clark had a high temperature. He was with him on the morning of July 5, and understood he was going to the Court. Mr. Sullivan: Do you think his absence was intentional? —Witness; No, I have known him for many years". He has notbeen right lately and is suffering from some mental aberration. The Magistrate - I do not think he tried away. The excuse is accepted and bail will not be estreated.
