Mrs. Dent counter-claimed for llm specific, performance of an agreement. allfU'cd (o have been made by Mrs. Cochrane lo purchrup an area of land at Ngav uawaliia.
His Honor said Mrs. Dent gave Mrs. Cochrane an option to purchase from her 17 acres of land at Ngaruawaliia, which were wanted as a gravel deposit. At the same time an option was given to Mrs. Dent bv Mrs. Cochrane for tho purchase of two houses at ('laudelands. He held that, the deals were dependent, on each other, and that as there had been an innocent misrepresentation on the part of Mrs. Dent regarding the quantities of gravel in the area she offered Mrs. Cochrane, the latter was able to resist the counter-claim for specific performance. Mrs, Cochrane was given possession of the two houses, and was awarded judgment for rent for the period of occupation. As neither party had fully succeeded, each was ordered to pay her own costs.
