He held that, the deals were dependent, on each other, and that as there had been an innocent misrepresentation on the part of Mrs. Dent regarding the quantities of gravel in the area she offered Mrs. Cochrane, the latter was able to resist the counter-claim for specific performance. Mrs, Cochrane was given possession of the two houses, and was awarded judgment for rent for the period of occupation. As neither party had fully succeeded, each was ordered to pay her own costs.
