AGENT'S COMMISSION.
SALE OF OTAHUHU LAND. COURT RESERVES DECISION. A claim for £144 10s 6d arising out of the sale of sections of land at Otahuhu. was made by W. J. Tait, farmer, Avondale (Mr. Coates), against J. M. McVeagh, land agent (Mr. Fleming), in the Magistrate's Court yesterday, before Mr. F. K. Hunt, S.M. Plaintiff said he gave defendant the sole agency of 13 sections at Otahuhu, it being agreed that if he sold all he was to receive a commission of the purchase money above a certain agreed price. On the other hand, if all the sections were not sold defendant was to receive only the usual lawful commission. Out of the 13 sections plaintiff was left with five of the worst on his hands. The agent had received £219 in deposits and had retained three times more than the usual commission.
The defence was that the agent was entitled to receive all money above the prices agreed upon and that what had been retained was perfectly legitimate. Decision was reserved.
