A WIDOW'S ALLOWANCE.
COURT GRANTS INCREASE. The application made to the Supreme Court under the Family Protection .Act regarding the provision made under (lie will of the late .Tames McCutcheon, farmer, Bay of Plenty, fur his widow, was the subject of a judgment given by Mr. Justice Herdman yesterday. Mr. Finlay, on behalf of Mrs. McCntchonn, had moved f<>r an increase of the annuity of £4OO provided for in the will. His Honor said he could not agree that the testator had made adequate provision in the circumstances, for his wife. His whole estate was of the present value of £25,000, and the bulk of it, under the will, would eventually fall into the hands of the Bay <>f Plenty Hospital Board, the Barnardo Homes, and the British and Foreign Bible Society. The Court had. to bear in mind the fact that the widow was in delicate health, and was entitled to live in circumstances befitting the relict of a well-to-do farmer. He therefore ordered the Public Trustee, as trustee in the estate, to increase her annuity to £SOO a year, the costs of all parties to the application to be paid out of the estate.
