UNCOMPLETED LAND DEAL.
JUDGMENT AT HAMILTON!.

Judgment for defendant with costs,was given by Mr. Justice Herdman in a'case in which Eric Nelson Collins, farmer, of Rotokauri (Mr. Tompkins), sought to recover from Janet Harney, spinster, of Waihou (Mr. Strang), £2OO damages for alleged breach of agreement. Evidence was given that defendant agreed to buy plaintiff's property of 35 acres at Rotokauri and had signed a rough agreement and paid £25 "deposit. When the formal agreement wa|lpresented defendant would not sign it and said she would not proceed with the contract.
Mr. Strang applied for a nonsuit on the . ground that the .agreement did not contain all the essential terms of the contract as required by the statute. Mr. Tompkins contended that the rough agreement and the correspondence were sufficient to satisfy the statute. His Honor expressed the opinion that the agreement was lacking in an essential detail by failing to state definitely when the balance of the deposit was to be paid and by omitting mention of the second mortgage. The legal agreement had also been varied by the addition of a security over the stock.
