RACECOURSE TRESPASS.
COURT ALTERS DECISION. CONSIDERATION FOR WIFE. I he case of Claude Oswald McCully, in connection with which a. misundcrstandJ nwas caused last week through the noiso from passing traffic outside the Police Court. was dealt with yesterday. MrCully was charged with trespassing on •he 'lakapuna racecourse during a race meeting. At the first hearing McCully was fined £2O, and a,s time in which to pay was refused, ho was taken to to serve the default of one month's imprisonment. Tho next day the magistrate, Mr. d. W. Poynton, said a. mistake had been made owing to the, noise of the traffic in the street at the, time. The case would be re heard and accused would have, his liberty in tho meantime without bail. Yesterday the magistrate said the Court had reconsidered the. case, and in view of I he, fact that accused's wifo was ill, McCully would be placed on the same footing as Ihe man who was with him. Accused was convicted and ordered to come up for sentence when called on. The proceedings being over, Mr. Matthews, representing MeC'nlly's wife, said tho latter wished to bring an action for separation, but he, had not wished to mention (he. fact before the trespass charge was dealt with, in case if should prejudice McCully. The magistrate remarked, with a smile, that it. was mainly on account of the wife that the Court had let McCully off so lightly. The. separation case was fixed for nest Kridsuv.
