TRESPASS BY STALLIONS.
HAMILTON ACTION SUCCEEDS
FENCE CONSIDERED SUFFICIENT.

HAMILTON. Tuesday.
Reserved judgment was given by Mr. H. A, Young. S.M., at Hamilton this morning in the case in which L. N. Rust, storekeeper, of Horotiu, claimed from I!. D. Dubfield. farmer, of Horotiu, the sum of £22 7s 6d as damages for trespass by two stallions. Ho awarded plaintiff £20 for trespass rates, £1 for damages to a gate, and costs.
The question, the magistrate said, was whether the plaintiff's land was sufficiently fenced. He had made an inspection of the fence, and was satisfied that it was a proper fence under the Fencing Act.
Security of appeal was fixed at £10. Mr. Tompkins appeared for plaintiff, and Mr. Johnson for defendant.
