DISPUTED CONTRACT.
PAYMENT FOR WORK CONE. Chim and counter-claim were involved in an action before Mr. F. K. Hunt, S.M., in the Magistrate's Court yesterday. T. Tvnc, contractor, Mount, Eden (Mr. Galliiuffher), sued A. A. Donald, merchant, Epsom (Mr. Bone), for £19 10s 9d, as the balance alleged to be owing for labour and material supplied for path formation work in February and March, 1922. Defendant, who admitted owing £15 9s 9d, counter-claimed for £20, contending that plaintiff used material to that value, which defendant had supplied, on a joh on his mother's property adjoining. This allegation was denied by plain! iff. The magistrate, who considered the case should have been heard in 1922, adjourned proceedings till Monday to allow plaintiff to subpoena witnesses.
