" I /,;•■; ;.- :: —-—~, -• The ' admissibility of ~an unstamped agreement for sale in proving a land agent's claim for commission was disputed" in a case heard :, before Mr. R. W. Tate, >S.M., in the Magistrate's Court; H. Lewis, land agent (Mr. Thwaites) .claimed from C. F. Saaderar (Mr. .Wilson) the sum of £40 for I commission alleged to be due on the sale of h farm at Huapai. Plaintiff had already allowed defendant £22 108 reduction. Plaintiff had arranged an exchange between defendant and one Rogers, and obtained both parties', signatures to the agreement. Subsequently Rogers repudiated contract on the grounds of alleged misrepresentation by Sanders. The agreement was never stamped. '. '■:'■■■ 1 »In giving a decision the -magistrate held that the agreement was admissible to prove that plaintiff; had obtained Rogers' signature. He gave judgment for plaintiff for the amount claimed and costs. ;:/.-^';
