Supreme Court upheld the : Daugherty ruling under the Prohibition Amendment.. that foreign ships cannot bring v liquor within the three-mile limit, even; as sea stores, thus upsetting the Federal' Court injunctions. ■ - The Court simultaneously upheld the appeal against the Daugherty ruling banning liquor on American ; ships throughout the world, ruling that: there is nothing in the Prohibition Amendment; that prevents American . ships carrying liquor in foreign waters. /; ■ . • ' '. 1; ■:. The Supreme Court decisions were made on appeals from the Lower Court decisions, in the first instance by Mr. H. M. Daugherty, Attorney General, and in the second instance by the American shipping companies.' '-; 7 ,:; :r ' The Court's ruling is based on . the decision that the Prohibition Amendment is only applicable to physical territory under the United.. States' " sovereign control. Foreign and American shipping are thus placed on an equal footing, neither being allowed to bring liquor within the threemile limit, but both are able to carry it outside. \ ' ' „ " ;•;The Washington correspondent of the New York Times states . that the anu prohibition ; forces at first were inclined to take some satisfaction from the Supreme Court's decision. . They pointed out that American and foreign vessels could take on liquor at some port of call and leave itV. on - entering V", and departing from American territorial waters. The prohibition forces, however, apart from indicating that this would take some * vessels out of their way, asserted that legislation would be introduced in the coming session of Congress forbidding ; vessels ion American registry to carry liquors at any time; • The Shipping Board furthermore has announced that Government-owned vessels will continue : " dry " . irrespective. of the Court's decision. * :
