MR. T. W. ORTON MISSING.

INCOME TAX ASSESSMENT.

In the Practice Court, in Melbourne recently, application was made for substituted service of a writ upon Thomas West Orton, one of the promoters of the Badak Tin Mining Co. A sum of £9017 is claimed as income-tax from Orion. He lodged an objection against assessment, and at his request an appeal was lodged and a case stated for consideration of the High Court. The tax was payable on September 24, 1922, but Orton did not pay pending his appeal. Later a writ was issued- against him, but could not be served because it was found that ho had left Australia. Affidavits produced in Court stated that Orton sailed from Townsville on January 25 under the name of Thomas West Orton. He had landed at Thursday Island on January 29, and sailed again for eastern ports on February 10. Mr. Justice Weigalj said it was too much to ask him to assume that Orton, after having taken the risk of stopping in the State for four months, during which the writ could have been served, had suddenly become alarmed, and disappeared to avoid service. Ho declined to make the order asked, but added that the decision would not prejudice any later application accompanied by further information.
