ACTION OVER A LEASE.
JUDGMENT FOR DEFENDANT.
Judgment was delivered in the Supreme Court yesterday by Mr. Justice Stringer in an action by Arthur Cleave (Mr. Towle) against Alfred James Coleman (Mr. Richmond) concerning an agreement in respect of a lease of certain property. In addition to rent, the lease was subject to payment of an annuity of £400 to Charles W. Goodson for life, and the plaintiff claimed that under the agreement he was entitled to receive the annuity after Goodson's death in June, 1919. There being no joint credit upon which he could draw he sued the defendant personally for tho recovery of half the annuity.
The Judge said he could not sec upon what legal principle the plaintiff could maintain the action. Whether or not he had any remedy against the defendant in some, other form of action in respect of an advance of £700 it was impossible for him to form an opinion upon tho material before him.
The plaintiff was nonsuited, with costs on the highest scale, and as on a claim for £600.
