POSSESSION OF HOUSE.

SUPREME COURT ORDER.

Possession within seven days of a house at Dargaville was ordered in a case heard before Mr. Justice Stringer at the Supreme Court yesterday. The plaintiff, Lizzie C. Sergeant (Mr. Goulding). in 1920 sold to Wallace Harrison a property at Dargaville. She received £60 in cash, and under an agreement the defendant was required to pay off the remainder owing to her by instalments. For over a year, stated plaintiff, the defendant had failed to pay interest or instalments of the purchase money. He had also failed to pay instalments under a Government advances mortgage. It was alleged that the defendant had partially demolished a nmall shed and that the orchard and Ledges had been so badly neglected that to restore the property an expenditure of £50 would be required. The defendant was still in possession. The claim was for possession of the house, an order for the rescission of the agreement for sale and purchase, and the payment of £52 17s lOd, representing interest, rates, etc., due on the property, and damages to allow for the depreciation of the property. His Honor made an order for possession within seven days, and for the rescission of the agreement. He allowed £25 damages, and ordered the payment of the amount claimed.
