OWNERSHIP OF PROPERTY.
BOUGHT WITH WIFE'S MONEY.
WOMAN'S CLAIM SUCCEEDS. A claim to have certain property held jointly by herself and her husband, but which was purchased with her money, vested solely in her name, was brought before Mr. Justice Stringer in the Supreme Court yesterday, by. Sabina B. McEwen (Mr. Mackay). The case was brought under the Women's Property Actj 1908, and the property was said to have an equity of £400. Plaintiff stated that her husband merely acted as trustee in connection with the property, and should not have had it or any portion of it vested in his name. His Honor, after hearing argument, f ranted the application. He said plaintiff ad shown that the property had been purchased with her money, but for the purpose of stimulating her husband, Richard Duncan McEwen, she had doubtless put his name in as part owner. If he had worked and improved the property no doubt she would have given him a half share in it. Plaintiff was ordered to pay the costs of the Public Trustee, who defended the action, and for whom Dr. Fitchett appeared, by order of the Court, on behalf of the absent husband.
