JUDGE AND COUNSEL.
QUESTION OF ADJOURNMENT. [by tslbgiaph—own cobbesfondent.] HA2IIXTON. Tueaday. When an application was made to Mr. Justice Stringer for a case to bo adjourned because Mr. Ostler was engaged in an Auckland case and could not appear, His Honor said that, in the circumstances, if he had the power he ought to make counsel pay the costs personally. It was not fair for counsel to retain the brief when ho know that he could not be there to take the case. There was a number of counsel to Hamilton quite competent to take the case and Mr. .Ostler should have handed it back in tim« for some other counsel to he instructed. However, His Honor said he was not prepared to embarrass counsel's client and he granted the adjournment subject to costs being paid.
