A CHARGE DISMISSED.
SUPPLYING OF LIQUOR.
SEQUEL TO DROWNING ACCIDENT.
A charge arising out of a recent drowning accident at Onehunga was heard at the Onehunga Police Court yesterday, by Mr. W. R. McKean, B.M. Mm. Matilda Olson (Mr. Hanna), licensee of the Manukau Hotel, was charged with having sold beer to Alfred Warren on January 5 last, while he was in a state of intoxication. Sergeant J. A. Cruickshank, who prosecuted, said the charge was the outcome of the death of Warren, who was drowned through falling off a ship's gangway on the day in question. For tho defence, William S. Dennis, barman, said he served Warren with beer about 10 a.m., and at about noon. He saw Warren in the hotel shortly before 6 p.m., but did not serve him. Warren was quite sober. Mr. Hanna admitted that Mrs. Olson served Warren with a small glass of beer before the closing time, but she was satisfled he was not intoxicated. After hearing lengthy evidence, occupying about five hours, Mr. McKean said it had not been proved that Warren was intoxicated when he was supplied with a small beer, shortly before 6 p.m. The case was dismissed.
