■ ' .- ■ ■■■♦' .ii' " A NEWMARKET BY-LAW. ; CHALLENGED AS UNREASONABLE. A large number of traffic by-law cases were heard by Mr. J. W. Poynton, S,M., \ at the Police Court yesterday. When Clyde Bloomfield was charged • with having committed a breach of the Newmarket Borough by-law by driving round the corner from Broadway into Khyber Pass at greater than a walking pace, Mr. Holmden, on behalf of the Auckland Automobile Association; challenged the by-law as being unreasonable. Two constables gave evidence that the defendant rounded the corner at between 10 and 15 miles an hour. Defendant 'said he rounded the corner at about 5 miles. /o hour, but upon seeing there was no* traffic in Khyber Pass he accelerated immediately. It was then that the police saw him. The president of the Automobile Association, Mr. Coltman, and two members o! the executive, Messrs. G. Henning and W. Grayson, gave evi- ' donee regarding observations made at that corner from 8.30 a.m. to 0 o'clock last Friday. They stated that the association waa bent on motorists observing the by-laws, but this one was unreasonable. Tramcars, horse vehicles, and the majority of motorists did not observe it. They produced tabular results of times taken for '72 vehicles, and handed them to the magistrate. Decision was reserved. Claude Cameron was charged with hav- • ing failed to illuminate his number plate v adequately. " This is the first of a series v of prosecutions for this offence," said . Senior-Sergeant Rawle. "The trouble is that in Auckland the majority of motorists have insufficient,tail lights, and as thero are now on the market tail lights entirely adequate, there is no excuse." The magistrate said that as this was only the first case he would convict defendant and order him to pay costs. The following penalties were imposed fori breaches of the by-laws, the costs being lis or 9s except where stated :— For having ridden motor-cycles down Grey Ptreot at a dangerous speed," A. Heatherin<?ton, E. McKay, J. Whitford. B. E. Wilkins, and C. Nathan, each 10s; K L. Wilcox, Ss. For failing to give the signal to other vehicles or observe the traffio regulation, E. Norden, 10s and 13g'costs; L. Smith, A. D. K. Otway, McNab and Mason, S. Lester, W. S. Miller, C. T. Carlton, 0. Harvord, G. Bentley, and W. Gill, each 10s; H. S. Easteate, 10s and 30s costs: A. Brown, £1; W. T. Cummins, £2 and 21s cost*. For having no certificate, K. Dickson, 10a an'd 13s costs, and T. G. Richards, 10s and 9s costs. For riding on the same motor-cycle, M. McKeo and J.
