NO, DUAL CAPACITY.

A denial of a statement to the effect that every architect acts in a duai capacity as architect "and contractor, made by counsel in a building dispute heard in the Supreme Court on Tuesday, is given by the executive of the Auckland branch of the New Zealand Institute of Architects. The executive characterises the statement as contrary to fact, and harmful to the profession. In substantiation of its assertion, the executive quotes the following . extract from the instituto regulations:— He shall not accept any trade commissions, discounts, allowances, or any direct profit in connection with any work which ho ig engaged fa design or or with any professional business which may be entrusted to him. He shall not, while acting in a prolessional capacity, bo at the same time, without disclosing the fact in writing to his clients, a director or member of, or » shareholder in, or act as an agent for any contracting or manufacturing company, or" insurance company, or firm, or business; with which' he may have occasion to deal on behalf of his clients, or have any financial interests in any such business. Ho shall not receive, directly o; indirectly, any royalty, gratuity, or commission, on any patented or protected article used .on work which ho is carrying out for Tiis clients, unless and until such royalty. • gratuity or t commission, has been authorised in writing' by those clients. He shall not be tho medium of payments made on his clients' behalf to any contractor or business firm (unless specially as requested by his clients), but shall only issue certificates or recommendations for payment by his clients. ! ' , He shall 'not guarantee any estimate or contract by personal bond, nor shall he be a party to any building contract except as owner.
