ACCIDENT TO GROCER.
COMPENSATION DISALLOWED. DECISION OF THE COUET. The reseiTed decision of the Arbitration Court In the case of Albert Eugene King, grocer's assistant (Mr. Dickson) against Marriott and Co., Parnell (Mr. Richmond) has been delivered. The plaintiff sustained ' injuries while riding a bicycle when canvassing for orders. The claim was in respect of permanent partial incapacity. The medical evidence was at variance as to whether filaintiff at the time of hearing was any onger incapacitated, and a further defence was raised that the plaintiff was not a manual worker within the meaning of the Act, and that his earnings, namely, £6 . 2s 6d a week, were beyond the scale prescribed by the Act for other than manual workers. It was suggested that some Eayments which had already been made y the employer during the tempo, *«"v total incapacity prevented the defendant taking advantage of the second line of defence and the Court reserved its decision to enable argument to be put before the Court. Under the Court's decision the defence that the plaintiff was not within the scope of the Act is held to have succeeded and judgment is entered for the defendant I accordingly.
