The requirement of the Takapuna Borough Council's building by-law that building allotments must be not less than a quarter of an acre in area, which the Court of Appeal has held to be unreasonable, does not appear to be included in the regulations of othor local bodies in Auckland,

So far as the city is concerned, the by-laws contain no restriction as to size of allotments in the inner area, or old city boundaries. In the outer area of the city each district has its own regulations. In Grey Lynn and Archhill, for instance, the minimum area allowed for a building site is one-tenth of an acre; in Epsom, one-fifth of an acre; and in Remuera the minimum is set down as "a frontage of not less than 50ft. to some public street, and a mean average depth from the abutment on the front street of not less than 132 ft."

None of the regulations in the suburban districts beyond the city area provides for a minimum area of a quarter of an acre. In the borough of Newmarket no minimum area is specified. In Mount Eden and Devonport the by-laws provide for a minimum area of one-eighth of an acre with a 40ft. frontage. The area required to erect a building on in Mount Albert is the same, but the frontage required is 50ft. Building sections in Northcote must have at least a 50ft. frontage with a minimum depth of 80ft., and back sections must be a quarter of an acre, with at least a 10ft. frontage. The Onehunga by-law stipulates that a section must be at least 140 ft. by 100 ft., though a building may be erected on a 33ft. minimum frontage if the depth of the section is so increased as to bring the area up to at least 4000 square, feet. The by-laws in force in the One Tree Hill and Mount Poskill road districts provide for a minimum area of one-fifth of an acre and a minimum frontage of 50ft.
