«t> ALLEGATIONS OF DESERTION. N , ONE DECREE NISI GRANTED. A decree nisi was granted by Mr. Justice Adams in the Supreme Court yesterday on the undefended petition of Martha Moore (Mr. Dickson) for divorce from Eichard James Moore, on +he ground of desertion. Petitioner stated that she was married in July, 1910, and there were no children. She had not seen him since April, 1914, when he left her in Auckland to go to Pukekohe, telling her at the railway station that she could go her own way, and he would go his. She had been earning her own livelihood since then. Her husband was always drinking. Evidence was beard in an undefended case, in which Violet Blanch Stewart Gow (Mr. J. F. W. Dickson) petitioned for a divorce froia Nathaniel Cameron Gow, on the ground, of desertion. The petitioner stated that she was married on March 24, 1915, in Auckland, and had one child. Shortly afterwards her husband was placed on probation for two months for theft. He failed to obtain work, and she went to live with her mother... Her husband was then sentenced to three months' imprisonment for theft, and to three years' reformative treatment for breaking the terms of his probation order. When rekased he went to his people's home, and failed to support her. She had summoned him four or five times since September, 1919, for failing to maintain the child. He was now £9 in arrears. Andrew John Blair, petitioner's brother, said Gow did not appear to get any work. His Honor: Why did he not get work? Witness: I think because he was tired. (Laughter.) His Honor here suggested a donbt as to whether failure to maintain could be regarded a 6 desertion, and the case was adjourned until this morning to enable counsel to submit authorities.
