LAND SALE DISPUTE.
RESCISSION OF CONTRACT. An action for the rescission of a contract in respect to i.he purchase of a block of land on the west coast, Auckland, by William Huey, secretary, and Charles Frederick Cork, accountant (Mr. Inder), both of Auckland, from Chennery ouggato and his wife, Helen Greening Suggate (Mr. Johnstone), was commenced at the Supreme Court ye-sterday, before Mr. Justice Hocking. The plaintiffs, Messrs. Huey and Cork, claimed £300, the deposit paid on the purchase, and £5114 5s 9d interest and other charges arising out of the contract. Counsel for plaintiffs said the claim was based on alleged misrepresentation regarding road access to the property. The defence was a denial of the allegations. After hearing evidence at 6ome length His Honor found that the contract must set aside, not on the ground of fraud, hut- because the representation, was ambiguous. The plaintiffs understood the representation to refer to the branch road leading to the while defendant inbonded it to refer to the Karekare Road. jlie question as to the amount of money to be refunded was left over for consideration to-day.
