MOTORIST'S FINE REFUNDED. I ' SEQUEL TO CIVIL ACTION. Wilson, S.M., 5 1 presiding. , I Mr. Meredith, on behalf 'of Bonnar L j stated that a civil action had been _ | brought recently against his client by ( j another motorist, who alleged that he had , , been forced into collision with a teleI I graph post by Bonnar's negligent zigzagging on the road. Evidence additional to that produced at the Police Court had been available, with the result that the magistrate had found that the plaintiff " in the civil action, and not the defendant was responsible for the accident. The new facts had been brought before the notice of the police and a re hearing oi the by-law case had been granted, which automatically brought about the cancellation of the conviction and fine. Sub-Inspector Wohlmann stated that the re-hearing had been fixed for that day, but if the information now available had been befor? the police previously no prosecution,would have taken place at all He did not propose to proceed with the matter. The magistrate accordingly dismissed the information against Bonnar, and stated that the fine of £5 would be refunded. The conviction had already been cancelled. J i
