DISPUTE OVER MORTGAGE.
CLAIM BY A MAORI
An action was brought before Mr. Justice Sim in the Supreme Court yesterday, by Hoani Nuku (Dr. Bamford)." a, Maori' residing at Whakatane, against William Phillips (Mr. R. McYpagh), settler, Whakatane, in connection with a leasehold property alleged to have en transferred to the plaintiff hv the defendant. Plaintiff, having executed a mortgage to the defendant to secure certain moneys, payable under a bank guarantee, brought forward the claim in the action to have the mortgage declared invalid, on the ground that it had not been eontirmrd, or. altemat vely, to have an account stated in order that ho might redeem the property. ' l The defendant admitted the execution of the transfer and mortgage, hut alleged that the whole transaction, at, » later date, had been verbally cant el bv agreement between the parties. A number of other legal defences were also rai-cd After formal proof had been given for the plaintiff, evidence for the defence was cal'ed. The case was adjourned until to-day for legal argument.
