DIVORCE SUIT SETTLED.

THE PETITION WITHDRAWN. HOPE OF RECONCILIATION. An amicable settlement was effected yesterday with regard to the divorce case heard in the Supreme Court on the previous day, before Mr. Justice Cooper and a jury of twelve, in which Gladys Constance Logan (Mr. Singer) sought the dissolution of her marriage to Martin Logan, farmer (Mr. Ostler), on the ground that a complaint from which he was suffering caused her to suspect that he had had illicit relations while in camp with some unknown woman. On the Court resuming Mr. Singer stated that since the previous day he had considered the position, and he agreed that in view of Dr. Scott's evidence his client was not in a position to prove the misconduct alleged against her husband in the petition. He therefore asked His Honor to withdraw the case from the jury, in which event, be presumed, the Court would dismiss the petition. ' Mr. Ostler, for the respondent, agreed to this course. His client, .he said, had fought for his character in defending the \ case. He trusted there would be some [expression by the Court of the opinion that the petitioner had failed to prove her j case. :. Mr. Justice Cooper said he considered a very proper course had been adopted. After conferring with counsel, he felt that there was no collusion about the withdrawal. ,■ He was also satisfied, and he 'felt sure the jury would be of opinion, from the evidence of Dr. Scott, that the respondent had not been suffering from the disease alleged. The basis of fee suit therefore failed. He felt that it would be satisfactory to both parties that this should be stated in court. There was legal precedent Tor dismissing a petition by conse'nt. His Honor expressed the hope that the young couple would find themselves in a position later on to become reconciled. Counsel intimated that they would do their utmost to that end. The petition was accordingly dismissed.
