PROPERTY SALE DISPUTE.
CLAIM AND COUNTER-CLAIM. A dispute over the sale of a property ! and stock at Bickerstaffe led to a civil action being heard before Mr. J. W. . Poyntonj, S.M., in the Magistrate's Court I yesterday. The plaintiff was Mrs. H. McMurdo (Mr. Prendergast) ana" the defendant A. C. Booth (Mr.Vallance), fanner, Mauncaturoto. The evidence showed that plaintiff recently sold a farm and stock to the defendant, but upon taking possession the latter found that certain of the stock i was missing. He therefore declined to 1 pay the interest due on a mortgage, and I Mrs. McMurdo sued for £160 2s 6d. This amount the defendant confessed, but he entered a counter-claim for £104 15s, damages for the alleged short delivery oi the stock. ' The magistrate said that if a man gay< a clear understanding to deliver certair chattels and was paid for them iany shorl delivery must be mad good. He must accept Booth's statement that a few days after the purchase a tally of the sheep » showed that the stock was short. He con sidered the price of the sheep a little overestimated, and accordingly reduced the amount to £93 15s, for which judgment was given for the defendant on the coun-ter-claim.
