DISPUTED WAGES CLAIM.
A MARINER'S DISMISSAL.
An action involving a claim by Herbert Subritzky' (Mr. Matthews), mariner, for £32 9s 6d, against fee New Zealand Coi-omandel Granite Quarry Development Syndicate (Mr Richmond)! was heard at the Magistrate's Court before Mr F K. Hunt S.M. The amount ' was claimed to be due to the plaintiff in part for wages while acting as master of the syndicate „ scow Lena Gladys, and in part for wages m lieu of notice of dismissal. A counter-claim was entered by the defendant syndicate for £53 10s 6d for the plaintiff alleged use of the Lena Gladys in taking a load of machinery to 1 names, and for refusing to take a load irom 1 names to Whangamata. Counsel for plaintiff said his client declined to take the load from Thames to Whangamata as the Lena Gladys was not sufficiently equipped for such a voyage He was thereupon dismissed without sufficient notice or payment in lieu of notice flaintiff admitted having received £5 14s 4d, which was accepted without prejudice. * • The magistrate gave judgment for the plaintiff on the claim for £26, and for the defendant syndicate on the counterclaim for 17s.
