DAMAGE TO A FENCE.
ACTION OVER EXCAVATION
I An action to recover the mm of £25 to cover damage alleged to have been I caused to a fence at Grey Lynn as the ! result of an excavation, was heard before I Mr. E. 0. Cutten, S.M., at the .Magis- [ trate's Court yesterday. The plaintiff was | Cuthbert A. Wright., (Mr. Durham) and the defendant George H. Woods (Mr. Sexton). The defence. was a denial of liability on the grounds that the excavation I was carried out by two men who had since been killed in France, and, further, J that the damage to the fence was not I caused by the excavation.' After viewing the property the magi.---trate gave judgment for plaintiff for £7 . 10s. He said the ]<.«. of land was only slight, and he would allow £3 10« for this and £4 fur the replacing of the fence. The defendant had ererted a concrete wall ?.*, the excavation, which would remove the chief danger, and if the cost of the wall (£l6 10<) were {nken into account ! it would be seen that the original claim | had nearly been met.
