LEGAL ACTION BY RESIDENTS.
COMPANY'S OBLIGATIONS.
QUESTION OF LOCAL AUTHORITY.
The legal action which a meeting of Takapuna residents on Tuesday evening deeded to take against the Takapma Tramway and Ferry Company, •was mentioned before Mr. Justice Chapman in Chambers in the Supreme Court yesterday. The plain tiffs in the action are R. E. Cunningham, F. W. Retter, A. Fulljames, members of the Takapuna Borough Council, and E. E. Gnmwade, president o:r the Takapuna Ratepayers' and Residents' Association. They ask for a declaratory judgment on the question of the company's duties in respect to its timetables, and as to whether the Takapuna Borough Council or the Waitemata County Council ia the body having power to make by-laws controlling the trams. Mr. A. -.1. Gould, on behalf of the petitioners, applied to the judge for directions respecting the bodies or persons who shculd be served as defendants.
His Honor intimated that he would consider the matter and give his decision later.
A letter on the subject of the tramway and ferry service has been forwarded by the Mayor of Takapuna, Mr. W. Blomfiefd, and the Deputy-Mayor, Mr. R. S. H. Biss, to the chairman of directors of the company, the Hon. E. Mitchelson. They ask that the 9 a.m. tram from Milford shculd be reinstated, and that the trams connecting with the daily 5.15 p.m. boat, and the 12.15 p.m. boat on Saturday, should run to Milford, via Hurstmere, and round the back of the lake. The suggestion is also made that there should be late boats on Wednesdays and Saturdays, with connecting trams, to enable people -to- attend entertainments in the city. The writers state: —"We are of the opinion that these alterations could be made at little or r»o extra cost to your company, and we feel sure they would be very much appreciated-, and won'd do much to remove the suggestion which has been freely made in the borough that your company is actuated by ' vind'etiveness. These suggestions are made without prejudice by the writers, who have not waited to consult the council, as they deem the matter one of great urgency."
