THE THISTLE HOTEL CASES.
CONVICTIONS, RECORDED.
Judgment, was given yesterday by Mr, F. V. Frazer, S.M., in the Police Court in the cases in which Joseph Audus Paynes, barman of the Thistle Hotel/ was charged with supplying liquor to a person apparently under th ° age of 21 years, and Bridget Sullivan, licensee of the hotel, with allowing the liquor to be supplied. Mr. Prendergast, for Mrs. Sullivan said ho supposed if the barman wero convicted a conviction against the licensee followed. But he thought if His Worship wore satisfied that Paynes had acted in good faith discretionary power might be exercised and the charge dismissed under section 92 of- the Justices of the Peace Act.
The magistrate said Raynes was a reliable and careful man, but it was clear 10 was ignorant of tlie. law as laid down by Mr. Justice Denniston. His nroper course was not to have been satisfied with the man's statement that he was 21 although there was no doubt he was satisfied. With regard to the licensee it was unfortunate that she was responsible for the act of her servant in a case, liko this, but at the ,samo time he could not dismiss tho case. .So far as the owners of tho hotel were concorned lie did not think they should .let thoconvictions affect them. Both defendants would be convicted, and ordered to pay costs, llaynes 15s , and the licensee -flu. .
