-<s» sale of mare by auction. FBT TELEGRAPH. —OWN" CORRESPONDENT.] Cambridge, Wednesday. At the S.M. Court on Tuesday the Farmers' Auctioneering Company sued R. H. Brady, auctioneer, claim £16. Defendant, entered a counter-claim for a like • amount. In this case defendant was shown to have purchased a horse at a clearing sale at £16. Although the advertisement advertising the sale stated the mare was in foal, the company's conditions of sale specifically stated that no guarantee would be binding unless given in writing. Later the mare proved not to be in foal, and defendant returned the mare, but the company refused to accept possession, and subsequently the animal was allowed to wander at large and, becoming impounded, was sold. A nonsuit was given on the claim and counter-claim, the magistrate considering the auctioneers were not liable, and that Brady should have insisted upon a guarantee in writing.
