A MF.MTU.n of tlio expeditionary torco appeared before Mr. C. C. Kettle, 8.M., at the Magistrate's Court yesterday to answer a judgment summons. Mr. Kettle asked the solicitor what authority ho hac to servo a summons against a soldier ol the King. The solicitor admitted thai the Army Act provided that 110 civil proceedings ,-hould bo taken against a. soldier if fie debt was under £30, but he contended that the defendant had joined the force since the debt was incurred and was now on tho ovc of leaving New Zealand without paying tho debt. Mr. Kettlo said that there was no objection to making a judgment against the defendant, but by tho present proceedings ho was being asked to put a man into gaol for debt, who had sworn to servo his King and country and was now about to leave New Zealand under military orders. On the application of tho solicitor, Mr. Kettle allowed tho matter to stand over in order that somo arrangement might bo come to iu tho meantime.
