STRANDING OP THE WESTMEATH. Mr. Justice Pickford, in the King's Bench Umsion, recently commenced the hearing of an action brought by the New Zealand Shipping Company against Mr. Duke, an underWa" 11 ! 118 out of * Policy of insurance, dated October 25, 1912. The policy was effected in respect of the plaintiffs' steamer Westmeath. upon certain risks and liabilities attached to her owners under the Merchant Snipping Acts, which impose certain liabilities upon owners of ships, if they meet with accident or disaster, to provide maintenance tor steerage passengers, and to carry them on in their own vessels, or to arrange for their carnage in other ships. In the case of the Westmeath, on September 16, 1913, when in process of taking on board her passen&ers. who were all cooked for Australia or New Zealand, the vessel stranded in the Mersey. Owing to the rush of emigrants to Australasia snd Canada at the time, there was great difficulty in finding accommodation for the Westmeath's passengers on other vessels. It was obvious thaw, the delay to the Westmeath would exceed uie six weeks allowed under the Merchant Shipping Acts for carrying on steerage passengers who were put in this plight. Eventually the New Zealand Shipping Company, which was a member of a pool, was able to secure accommodation for the stranded passengers in tee Federal liner Shropshire and other ships belonging to lines in the pool. The accommodation had to be specially provided. The plaintiffs paid the emigrants' passages in these ships. The Westmeath was detained for _73 days, until November 25. when she sailed on a new voyage with an entirely new get of passengers. Plaintiffs clamv9d the loss and expense incurred by the transfer of'the Westmeath s passengers Defendants contended that plaintiffs in November earned passage money which took the place of the passage money which thev alleged they lost owing to the uncompleted voyage in September. They did not. therefore, lose the passage money. Alternatively, defendants contended that they were entitled U- the money by way of salvage. Defendants further said that as plaintiffs were in tie pool, the pool were really the assured, and tliey.loet nothing, because they got for carrying in other ships the passage money which was paid in respect of the Westmeath. There was, therefore, no loss of or disbursement o;: passage money within the meaning of the policy. Mr. Justice Pickford reserved judgment.
